Investigation and special reports


An investigation report is a report prepared at the end of an investigation. It may contain findings, opinions and recommendations, and reasons why we have reached these conclusions.

A special report can be prepared at any time and can relate to any aspect of our functions, from investigations to administrative and policy matters. We use special reports to convey findings, opinions, recommendations, and the reasons why we have reached these conclusions, either to finalise an investigation, or during an investigation that remains ongoing.

Reports can be made confidential by leaving out information that could prejudice proceedings, identify certain people, or that is contrary to the public interest. A confidential report that does include this information can be given to a relevant Legislative Assembly committee, but is not published on our website.

*The Commission accepts that s 36 of the Inquiries Act is not capable of applying to a single member Board of Inquiry. In Federal Court proceedings NSD389/2025 commenced by Mr Sofronoff in relation to the Operation Juno report, the Commission did not seek to defend its finding that Mr Sofronoff engaged in conduct that could constitute an offence contrary to s 36 of the Inquiries Act 1991.
