There are certain people that can receive a report of disclosable conduct (which may later be assessed as a public interest disclosure). These people are called Disclosure Officers, and they include:
- the Public Sector Standards Commissioner
- the Head of Service
- the Auditor-General
- the Ombudsman
- the Integrity Commissioner
- the head of an ACT public sector entity
- the Clerk of the Legislative Assembly
- a person nominated to be a Disclosure Officer.
People who wish to make a public interest disclosure can also contact us directly.
Information for Disclosure Officers
As a Disclosure Officer, you must assess whether a disclosure is about disclosable conduct, and if it was made in good faith. If you are satisfied that it is about disclosable conduct, then you must refer the disclosure to us for assessment.
Disclosure Officers must take reasonable steps to protect the identity of disclosers, if known. However, Disclosure Officers are required to provide us with the discloser’s name and contact details, if the discloser has provided these, when referring a disclosure to us. This is not an offence, as sharing the discloser’s contact details are expressly required by the Public Interest Disclosure Act 2012.
ACT Government directorates and entities are required to notify us of any changes to their relevant Disclosure Officers as soon as practicable.
