Matters the Commission can't investigate
The Commission is not able to deal with:
- complaints that do not meet the requirements of the Integrity Commission Act 2018 or the Public Interest Disclosure Act 2012;
- complaints about the following categories, unless there is also a connection with the ACT public sector, and ACT public official, or public administration in the ACT:
- complaints about ACT Police (Australian Federal Police) or members of the ACT Police/Australian Federal Police.
- complaints about parliamentarians from the Commonwealth or of a state or territory (other than the ACT);
- complaints about public sector entities, public servants or statutory officers of the Commonwealth or a state or territory (other than the ACT);
- complaints about judicial officers from the Commonwealth or of a state or territory (other than the ACT);
- complaints about local councils or employees of local councils of a state or territory;
- complaints about the conduct of public sector entities or officials that occurred before Self-Government (11 May 1989);
- complaints about matters relating to the merits of a decision, order or judgement made by a judicial officer; and,
- conduct relating to individual employment and industrial matters, including isolated allegations of bullying or harassment, individual performance management concerns, or individual workplace health or safety concerns.
The Commission has published a list of alternative complaint receiving entities which may be able to take action in relation to matters that it is not able to deal with.
