Mandatory reporters
People who must report conduct that they suspect on reasonable grounds to be serious or systemic corrupt conduct include:
- heads of public sector entities and senior executive service (SES) officers;
- the Auditor-General;
- the Ombudsman;
- the Electoral Commissioner;
- the Clerk of the Legislative Assembly; and,
- Members of the Assembly (MLAs) and their chiefs of staff.
The Commission has published mandatory corruption notification directions which are available via the ACT Legislation Register. These outline:
- the obligations of mandated reporters;
- the types of matters that must be notified;
- the form, content, and method of notification; and,
- other relevant information.
Reporting under the Public Sector Management Act 1994
Pursuant to the Public Sector Management Act 1994, a public servant must tell the following person about any maladministration or corrupt or fraudulent conduct by a public servant or a public sector member of which the discloser becomes aware:
- the head of service;
- if the alleged maladministration or corrupt or fraudulent conduct is by the head of service—
- the director-general of the administrative unit in which the public servant is employed; or
- if the head of service is the director-general of the administrative unit in which the public servant is employed—another director-general.
